Caleb — a personal coaching app by Caleb Foundry

Important — please read this first. These Terms include a disclaimer of medical advice, an assumption of the risks of physical exercise, and a limitation of our liability (Sections 9, 10, and 11). By using Caleb you confirm you have read and accepted them. Caleb is a fitness tool, not a doctor. Consult a qualified physician before beginning any exercise program. If you experience chest pain, dizziness, faintness, or any medical emergency, stop and seek professional medical help immediately.

1. Who we are and what these Terms cover

These Terms and Conditions (“Terms”) are a binding agreement between you (“you,” “your,” or the “user”) and Caleb Foundry, an individual sole proprietor operating under the trade name “Caleb Foundry” and based in Honduras (“Caleb Foundry,” “we,” “us,” or “our”). They govern your access to and use of the Caleb mobile application, the website at calebfoundry.com, and any related services we provide (together, the “Service” or “Caleb”).

By creating an account, subscribing, or otherwise using Caleb, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use Caleb.

2. What Caleb is

Caleb is a personal strength-and-endurance coaching application. It generates training sessions (“Mission Briefs”), collects your feedback after each session (“debriefs”), adjusts future sessions based on what you report, and lets you exchange messages with an AI coach character named “Caleb.” The coaching content is generated with the assistance of artificial intelligence (see Section 8).

Caleb is not: a medical device, a medical or healthcare service, a physical-therapy or rehabilitation service, a nutrition or diet service, a mental-health service, or a substitute for professional advice of any kind. It is a fitness-coaching tool intended for general informational and motivational purposes only.

3. Eligibility — you must be 18 or older

Caleb is intended only for adults. You must be at least 18 years old to create an account or use the Service. By using Caleb you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under the laws of your country or region. We do not knowingly permit anyone under 18 to use Caleb. If we learn that a user is under 18, we will terminate the account and delete the associated data.

4. Your account

To use most features you must create an account. You agree to provide accurate information, to keep your login credentials confidential, and to be responsible for all activity that occurs under your account. Notify us promptly at calebfoundry@gmail.com if you suspect unauthorized use. You are responsible for the security of the device on which you use Caleb.

5. Subscriptions, billing, renewal, and cancellation

5.1 Paid subscription

Caleb is offered as a paid auto-renewing subscription. We currently offer a single subscription tier, available on a monthly or annual basis. The exact price, billing period, currency, any free trial or introductory offer, and any eligibility-based discount (for example, a military or first-responder discount) are disclosed to you at the point of purchase inside the app or on the relevant store listing, before you confirm payment. Prices may vary by country and may change over time.

5.2 Billing is handled by Apple or Google — not by us

Subscriptions are sold and billed through the Apple App Store or Google Play Store, depending on the platform you use. Payment is charged to your Apple or Google account, not to us. We do not collect or store your payment-card details. Your purchase is also governed by the terms of the applicable app store (Apple Media Services Terms / Google Play Terms of Service).

5.3 Automatic renewal

Your subscription automatically renews at the end of each billing period (monthly or annual) at the then-current price, and your Apple or Google account is charged for the renewal, unless you cancel at least 24 hours before the end of the current period. The subscription continues until you cancel.

5.4 How to cancel

You can cancel at any time, and cancellation takes effect at the end of the current paid period — you keep access until then. You must cancel through your Apple or Google account, because that is where the subscription is managed:

• Apple (iOS): Settings → your name → Subscriptions → Caleb → Cancel.
• Google Play (Android): Play Store → Profile → Payments & subscriptions → Subscriptions → Caleb → Cancel.

We are not able to cancel a store-managed subscription on your behalf, though we are happy to point you to the right place.

5.5 Refunds

Because billing is handled by Apple and Google, refunds are governed by their policies, and refund requests must generally be made to Apple or Google, not to us. We do not control and cannot guarantee refunds. Where the law of your country grants you a statutory right to a refund or withdrawal (for example, certain consumer-protection or distance-selling rights in your jurisdiction), that right is unaffected by this Section. Contact us at calebfoundry@gmail.com if you believe you are entitled to a refund and we will do what we reasonably can to help.

5.6 Price changes

We may change subscription prices. If a price change applies to your renewal, you will be notified in advance as required by the applicable app store and law, and the change will take effect at your next renewal. Continuing the subscription after a price change takes effect means you accept the new price; if you do not accept it, cancel before the renewal.

6. Acceptable use

You agree not to:

• use Caleb if you are under 18 or otherwise not eligible;
• use Caleb for any unlawful purpose or in violation of these Terms;
• share, resell, or sublicense your account or access (Caleb is single-seat and personal to you);
• attempt to reverse-engineer, decompile, scrape, or extract the source code, prompts, or underlying models of the Service, except to the extent this restriction is prohibited by law;
• interfere with, overload, or disrupt the Service or its infrastructure, or attempt to gain unauthorized access to it;
• submit content that is illegal, infringing, abusive, or that you do not have the right to submit;
• attempt to use the AI coach to generate content unrelated to your own fitness coaching, or to circumvent its intended purpose.

We may suspend or terminate access for conduct that violates this Section.

7. Your content and our content

7.1 Your content

“Your content” includes the information you provide — your profile, equipment, baselines, goals, debrief notes, free-text messages to the coach, and similar inputs. You retain ownership of your content. You grant us a limited, worldwide, royalty-free license to use, store, process, and transmit your content only as needed to operate and improve the Service for you — for example, to store it in our database and to send relevant parts of it to our AI provider so the coach can respond. This license ends when your content is deleted, except for backups and as otherwise described in the Privacy Policy.

7.2 Our content

The Service, including the Caleb name, the coach character, the training content, text, design, logos, and software, is owned by Caleb Foundry or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use Caleb for your own personal, non-commercial training while your subscription is active. We reserve all rights not expressly granted.

7.3 Feedback

If you send us suggestions or feedback, we may use them without restriction or obligation to you.

8. Artificial intelligence — how coaching is generated

Caleb’s coaching is generated with the help of a third-party large language model provided by Anthropic (the “Claude” API). To generate your sessions and replies, relevant parts of your content — which may include your profile, injuries or physical limitations, training history, debrief notes, and chat messages — are sent to Anthropic’s API for processing. You understand and agree that:

• AI-generated coaching can be inaccurate, incomplete, or unsuitable for your specific circumstances. It is general information, not personalized professional, medical, or therapeutic advice.
• The coach character is not a real person, not a licensed trainer, and not a medical professional.
• You are responsible for using your own judgment, and for consulting qualified professionals, before acting on anything the Service generates.
• Automated logic helps decide what session to suggest next. This is a fitness convenience feature, not a decision that produces legal or similarly significant effects about you. You can stop using the Service at any time.

9. Health and fitness disclaimer — read carefully

Caleb does not provide medical advice. All content in the Service is for general informational and fitness purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

• Consult a physician first. You should consult a qualified physician or other healthcare provider before beginning any exercise program, especially if you are pregnant, recovering from injury or surgery, have a chronic condition, are over 40 and inactive, or have any cardiovascular, musculoskeletal, or other health concern.
• Listen to your body and stop when needed. Never disregard professional medical advice or delay seeking it because of something in the Service. If you feel pain, dizziness, shortness of breath, chest discomfort, faintness, or any symptom that concerns you, stop exercising immediately and seek medical help.
• No guarantees. We make no representation or guarantee about any particular fitness, strength, weight, health, or performance result. Results depend on many factors outside our control.
• Information you give us may be wrong or incomplete, and the coach relies on it. The quality and safety of the suggestions depend in part on the accuracy of what you report.

10. Assumption of risk

Physical exercise carries inherent risks, including the risk of serious injury, aggravation of existing conditions, and, in rare cases, death. By using Caleb and performing any activity it suggests, you knowingly and voluntarily assume all risks associated with exercise and with your use of the Service, whether or not those risks are foreseeable. You are solely responsible for choosing whether to perform any suggested activity, for using proper form and appropriate equipment, for training in a safe environment, and for stopping when you should.

11. Disclaimers and limitation of liability

11.1 “As is”

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content is accurate or suitable for you.

11.2 Limitation of liability

To the fullest extent permitted by applicable law, Caleb Foundry will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury or property damage, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us, or paid through the applicable app store for the Service, in the twelve (12) months before the event giving rise to the claim, or (b) USD $50.

11.3 What this Section does not exclude

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you — for example, liability for death or personal injury caused by our gross negligence or willful misconduct, for fraud, or any non-waivable rights you have as a consumer under the mandatory law of your country or region. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you, in which case our liability is limited to the smallest extent permitted by law.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Caleb Foundry from any claims, damages, losses, and reasonable expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This Section does not apply to the extent a loss is caused by our own wrongdoing.

13. Termination

You may stop using Caleb at any time and may cancel your subscription as described in Section 5. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 7.2, 9, 10, 11, 12, and 15) survive termination. For what happens to your data, see the Privacy Policy.

14. Changes to the Service and to these Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may also update these Terms. If we make a material change, we will take reasonable steps to notify you (for example, an in-app notice or an update to the “Last updated” date). Changes take effect when posted unless stated otherwise. Continuing to use Caleb after changes take effect means you accept the updated Terms; if you do not accept them, stop using the Service and cancel any subscription.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Honduras, without regard to its conflict-of-laws rules. Subject to the next sentence, you agree that the courts of Honduras will have jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in this Section deprives you of the protection of mandatory consumer-protection laws, or of the right to bring proceedings in the courts, of the country where you live, where the law grants you that right.

16. App store terms

Your use of Caleb obtained through the Apple App Store or Google Play is also subject to that store’s terms. Apple-specific terms: you and we acknowledge that these Terms are between you and Caleb Foundry only, not with Apple; Apple is not responsible for the Service or its content; Apple has no obligation to provide support or to address any claims relating to the Service; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service, and any claims, losses, or costs attributable to a failure to conform to a warranty are our responsibility, not Apple’s.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the Service. Headings are for convenience only. In case of conflict between a translated version of these Terms and the English version, the English version governs to the extent permitted by your local law.
